- Be based within a jurisdiction where the purchase of NFTs is legal. This is the sole liability of you as the purchaser.
- Provide an ERC-20 compatible wallet address for the purchase of NFTs. - Whitelist Selection: The selection of participants for the presale whitelist will be at the sole discretion of EXN Co Ltd (“the issuer”), the owner of this Horses Having Horns NFT series. The company may consider various factors when selecting participants, including but not limited to previous engagement with the issuer's NFTs or brand, social media presence, and compliance with the eligibility criteria.
- Presale Details: The presale will have a limited number of NFTs available for purchase. Participants on the presale whitelist will have the opportunity to purchase NFTs before they are made available to the public. The presale price for the NFTs may differ from the public sale price.
- Payment: Participants on the presale whitelist will be required to pay for their NFTs using cryptocurrency, as specified by the issuer which in this case is specifically Ether (ETH). Payment must be made within a specified timeframe, or the participant may forfeit their right to purchase the NFT.
- NFT Delivery: The issuer will deliver the NFTs to the participant's specified ERC-20 compatible wallet address. The NFTs will be delivered within a reasonable timeframe after payment has been received. It is the participants sole responsibility to provide correct details. If an error of any type occurs due to the provision of incorrect information by the participant (i.e. wallet address details), the issuer is not responsible nor liable for the lack of delivery of an NFT.
- No Guarantee: Participation in the presale whitelist does not guarantee the purchase of an NFT. The issuer reserves the right to cancel the presale or modify the terms and conditions at any time, without notice.
- No Refunds: All sales are final, and no refunds will be issued.
- Legal Compliance: Participants on the presale whitelist are responsible for complying with all applicable laws and regulations in their jurisdiction regarding the purchase and ownership of NFTs.
- Intellectual Property
- The participant purchasing the NFT, will own the NFT and any associated intellectual property rights, to the extent permissible by law. However, the issuer makes no representations or warranties regarding the extent of the buyer's ownership rights or any third-party claims to the underlying intellectual property.
- No Guarantee of IP Ownership: the issuer does not guarantee that the participant purchasing the NFT will have full ownership of any intellectual property associated with the NFT, and the buyer assumes all risks and liabilities associated with such ownership.
- Compliance with Applicable Laws: The participant purchasing the NFT is responsible for complying with all applicable laws and regulations regarding the ownership and use of intellectual property rights associated with the NFT.
- Disclaimer of Warranties: The issuer makes no representations or warranties, express or implied, regarding the ownership or use of any intellectual property associated with the NFT.
